ClarityCheck AI Terms and Conditions

Last Updated: October 29, 2026

1. INTRODUCTION

Welcome to ClarityCheck, your trusted platform for AI content detection, plagiarism checking, and related writing tools. These Terms and Conditions (“Terms”) govern your access to and use of our Services, including but not limited to AI detection, plagiarism checking, text rewriting (the “Humanizer” and the “Plagiarism Remover”), and any associated features, subscriptions, or one-time purchases (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

These Terms apply only to ClarityCheck AI. The ClarityCheck Terms and Conditions continue to govern reverse lookup services, including where both are used through the same account.

These Terms establish a legally binding agreement between you (“User”) and the operator of the Services (referred to as “we,” “us,” or “our”). If you do not agree to these Terms, you must refrain from using the Services.

The Services are offered exclusively to individuals who are at least 18 years old and who agree to use them in compliance with all applicable laws and regulations. By using the Services, you represent and warrant that you meet these requirements.

We reserve the right to modify these Terms at any time. Changes will take effect upon posting to our website or upon direct notification to you. Your continued use of the Services constitutes acceptance of the revised Terms.

By proceeding, you acknowledge that you have read, understood, and agree to these Terms in their entirety. If you have any questions or require clarification, please contact our customer support team before using the Services.

ClarityCheck shall not be liable for any delay or failure to perform its obligations under these Terms and Conditions resulting from any cause beyond its reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, labor disputes, governmental action or restriction, internet or telecommunications failures, power outages, third-party service or data provider outages, cyberattacks, or pandemic. Performance shall be excused for the duration of such event, and ClarityCheck will use commercially reasonable efforts to resume performance once the event has ended.

Please read these Terms and Conditions carefully, including the class action waiver and informal dispute resolution requirements in Section 24, which affect your legal rights.

2. CLASS ACTION WAIVER

BY USING THE SERVICES, YOU AGREE THAT ANY DISPUTES, CLAIMS, OR CONTROVERSIES ARISING OUT OF OR RELATED TO THESE TERMS, THE SERVICES, OR YOUR USE OF THE SERVICES WILL BE RESOLVED EXCLUSIVELY ON AN INDIVIDUAL BASIS. YOU EXPRESSLY WAIVE YOUR RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION AGAINST THE SERVICES OR THEIR OPERATORS. ARBITRATION OR ANY OTHER LEGAL PROCEEDING RELATED TO A DISPUTE UNDER THESE TERMS SHALL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS, AND NO CLASS ARBITRATIONS, CLASS ACTIONS, OR PRIVATE ATTORNEY GENERAL ACTIONS WILL BE PERMITTED.

THIS CLASS ACTION WAIVER IS A MATERIAL AND NON-SEVERABLE PART OF THESE TERMS. BY AGREEING TO THIS PROVISION, YOU ACKNOWLEDGE THAT YOU ARE WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. IF THIS WAIVER IS FOUND TO BE UNENFORCEABLE OR INVALID IN ANY JURISDICTION, ALL OTHER PROVISIONS OF THESE TERMS SHALL REMAIN ENFORCEABLE TO THE FULLEST EXTENT PERMITTED BY LAW.

3. SERVICES

The Services provided include AI detection, plagiarism checking, the Humanizer, and the Plagiarism Remover, which operate in a similar manner and under the same terms, structure, and payment options. These Services allow you to submit text (“Submitted Text”) and obtain results (“Results”), which may include, but are not limited to:

AI Detection: an estimate of the share of the Submitted Text that reads as machine-generated and of the likelihood that the text as a whole was generated by an artificial intelligence system, together with the passages that contributed to that estimate.

Plagiarism Checking: a similarity score and the passages of the Submitted Text that match web pages, academic sources, and archived content, together with the matched sources.

Humanizer: a rewritten version of the Submitted Text intended to read more naturally while preserving its meaning, facts, figures, and quotations.

Plagiarism Remover: a rewritten version of the passages of the Submitted Text identified as matching a source, leaving the remainder of the Submitted Text unchanged.

The Humanizer and the Plagiarism Remover are writing tools intended to improve the wording of your own text. They are not intended to bypass AI detectors, plagiarism checkers, or the policies of any school, publisher, platform, or employer, and we make no representation that rewritten text will avoid detection. Where the use of AI tools is restricted or must be disclosed, you are solely responsible for complying with those requirements.

The Plagiarism Remover operates only on passages identified as matching a source in a completed plagiarism check. Where no matching passages are identified, no rewrite is performed and no credit is used.

Users acknowledge that Results are probabilistic estimates and that their accuracy may vary depending on the length, language, genre, and degree of editing of the Submitted Text, as well as on paraphrasing, translation, mixed human and machine authorship, and changes to the artificial intelligence systems that generate text. AI detection Results consist of a passage rate, being the share of the Submitted Text that reads as machine-generated, and a document probability, being the estimated likelihood that the text as a whole was machine-generated; these measure different things and may differ from each other. Before purchase, the Services may display a free preliminary analysis based solely on writing patterns in the Submitted Text (“Scan Signals”). Scan Signals do not use the detection or plagiarism service, do not consume credits, and may differ from the Results of a full scan. Scan Signals are not a Result and do not include any score or percentage. They give a general estimate, based only on writing patterns found in the Submitted Text, of how likely text with those patterns is to be flagged as machine-generated or to match published sources. Scan Signals are not produced by any third-party detector or plagiarism checker and do not predict the outcome of any particular detector, plagiarism checker, school, publisher, platform, or employer.

Each submission must contain between 50 and 15,000 words. Where text exceeding 15,000 words is submitted, only the first 15,000 words are analysed. Text may be pasted directly or uploaded as a .doc, .docx, .pdf, or .txt file. Only the text content of uploaded files is analysed; images, formatting, and embedded media are disregarded.

As part of the Services, we offer a “Scan History” feature that allows you to re-access your previously generated Results and rewritten text without submitting the same text again. When you use the Services, we retain the Submitted Text, the Results, and any rewritten text generated at your request and associate them with your account for the limited purposes described in these Terms.

Scan History is maintained solely to improve user experience and convenience by allowing you to re-access your own previously generated Results, and for limited related purposes such as security, fraud prevention, debugging, customer support, and legal compliance. We do not use Scan History to create profiles about individuals, to enrich data for unrelated purposes, to sell or license Submitted Text or Results, or to use them for advertising targeting, automated decision-making, profiling, or model training, except to the extent explicitly disclosed in our Privacy Policy and permitted by applicable law.

Scan History is intended solely for the user account that generated it and is accessible only after authentication. Scan History is not publicly displayed, is not searchable or indexed for public discovery, and is not accessible to other users.

Submitted Text, Results, and rewritten text are retained for up to one hundred twenty (120) days, after which they are automatically deleted from our active systems within a commercially reasonable timeframe, subject to limited exceptions for security, fraud prevention, backups, and legal compliance. You may delete any entry from your Scan History at any time.

AI detection and plagiarism checking are fulfilled using PlagiarismSearch, and text rewriting is fulfilled using OpenAI, each a third-party provider identified in our Privacy Policy. Submitted Text is transmitted to these providers solely to perform the requested service and is subject to the retention terms described in our Privacy Policy.

Our Services are designed for personal, informational use only and are not intended for use in decision-making processes where accuracy and completeness are critical, such as academic discipline, employment, legal, financial, or other regulated purposes. By using the Services, you agree to comply with all applicable laws and to use the Results responsibly. The Services are offered to individual users only and are not offered to schools, universities, employers, or other organizations for processing student, staff, or applicant data under an institutional agreement.

Users may access the Services through paid subscription plans or one-time purchases, as described below:

7-Day Trial: Users may begin with a paid 7-day trial, which includes 2 credits. Following the trial, users may transition to a weekly, 28 (twenty eight) days or 30 (thirty) days subscription, depending on the offer. The exact tier is listed on the billing page prior to purchase and in your confirmation email.

Standard Subscription: Provides 20 credits per 28 or 30 days. Unused credits accumulate and carry over into subsequent billing cycles, up to a maximum balance of 100 credits at any given time.

Credit Usage: Each submission to AI detection, plagiarism checking, the Humanizer, or the Plagiarism Remover uses one (1) credit, including a further check on text previously submitted. Scan Signals do not use credits. A submission that fails to complete does not use a credit.

Additional Credits: Users can purchase credit packages (10, 25, or 50 credits), which roll over into subsequent billing cycles until fully used. Credits do not expire. Purchased credits are used after subscription credits have been used. Credits included with your subscription and credits you purchase separately both remain in your account until you use them, including after you cancel your subscription. Your account can hold a maximum of 100 credits at any one time.

One-Time Option: Users can enhance their experience by purchasing optional features, including:

PDF Downloads: Enables downloading Results in PDF format.

The Services include clear disclaimers on each page, specifying the nature of the payment and any recurring charges. Users are notified via email regarding subscription start dates and charges after the trial period. It is your responsibility to review these disclaimers and notifications before proceeding.

By using the Services, you agree to these Terms and acknowledge that all Results are subject to the limitations and restrictions outlined herein.

4. ACCOUNTS AND LOGINS

To access and use the Services, you are required to provide a valid email address. Access to the platform is granted via a magic link sent to your email or by signing in with Google. By requesting access, you agree to provide accurate, current, and complete information during the registration process and to update this information promptly if it changes. You are solely responsible for maintaining the security of your email account and ensuring that no unauthorized parties access the magic link sent to you.

Access to the platform is provided only after initiating a trial period for new users. Pricing is always shown on the billing page before purchase and users will receive information over email after the payment is made. Upon completing the trial, continued access to the Services may be subject to additional subscription fees or terms as outlined in these Terms.

You agree not to share the magic link or allow unauthorized parties to access the Services through your email. If you suspect any unauthorized access or misuse of your account, you must notify us immediately. We reserve the right to suspend or terminate access if we detect unauthorized use, misuse, or violations of these Terms.

Access to the platform is intended for individual use only. You may not create multiple accounts using different email addresses or transfer access to another person or entity without our prior written consent. We reserve the right to refuse, restrict, or terminate access to the Services if fraudulent or unauthorized activity is detected.

By accessing the platform and using the Services, you acknowledge that you are at least 18 years old and legally capable of entering into these Terms. You further agree to abide by all applicable laws and regulations when using the Services.

We may, at our sole discretion, limit access to certain features or functionality of the Services based on your trial status, subscription level, or account activity. It is your responsibility to ensure that your use of the Services complies with all requirements and restrictions outlined in these Terms.

Users have the right to request the permanent deletion of their accounts, including all associated data. To delete an account, users must visit the account deletion page and enter the email address associated with their account. A one-time password (OTP) will be sent to the provided email for verification purposes. Once verified, the account deletion request will be processed, and all data, including stored email addresses, Scan History, and remaining credits, will be permanently removed from our database. Upon deletion, users will no longer be able to log in using the deleted email, and all unused credits will be forfeited. However, users may create a new account in the future using the same email.

For security reasons, account deletion requests must be submitted through the designated webpage. Customer Support representatives will direct users to this page for account deletion inquiries and will not process deletion requests manually.

Additional details on account deletion can be found in the Help Center under 'How to Delete My Account.'

5. LICENSE TO USE

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Services solely for your personal, non-commercial purposes. This license is provided strictly in accordance with these Terms and does not grant you any ownership rights to the Services or their content, except that you retain ownership of your Submitted Text and of the rewritten text generated from it, as set out in Section 6.

You may use the Services only as intended and in compliance with applicable laws and regulations. Any unauthorized use of the Services, including but not limited to scraping, copying, reproducing, distributing, modifying, or reverse-engineering the platform, its content, or associated software, is strictly prohibited. You may not attempt to interfere with or disrupt the functionality of the Services, circumvent any security measures, or engage in any activity that compromises the integrity of the platform.

This license is contingent upon your adherence to these Terms. We reserve the right to suspend, terminate, or restrict your access to the Services if you violate these Terms or engage in any unauthorized or abusive behavior. The license automatically terminates if your access to the Services is canceled, terminated, or otherwise restricted.

All rights not expressly granted to you under these Terms are reserved by us and our licensors. You acknowledge and agree that the Services, including any associated intellectual property, are protected by copyright, trademark, and other applicable laws. Any unauthorized use of the Services will result in the immediate termination of this license and may subject you to civil and criminal penalties.

6. CONTENT

The content provided through the Services, including but not limited to Results, scores, highlighted passages, matched sources, rewritten text, and associated materials (“Content”), is intended solely for informational purposes. While we strive to ensure the accuracy and reliability of the Content, we do not guarantee that it is complete, error-free, or up-to-date. Results are generated automatically using third-party analysis and language-model providers and are probabilistic estimates, which may include inaccuracies or omissions. Human-written text may be identified as machine-generated, machine-generated text may not be identified, and a match to a source does not in itself establish plagiarism. Content is Not “Real Time”; Snapshot Nature of Results. You acknowledge and agree that Content reflects the analysis available at the time the Results are generated, and we do not guarantee that the same submission will return the same Results at a later time.

By using the Services, you acknowledge and agree that the Content:

Is provided “as is” and is subject to inherent limitations based on the nature of automated analysis.

May not be used as a substitute for professional advice or relied upon as proof of authorship, originality, or misconduct, or for academic, legal, financial, employment, or other critical decision-making purposes without independent verification.

Is not guaranteed to meet your specific needs or expectations, including any requirement of a school, publisher, platform, or employer.

You are solely responsible for how you use the Content and for any consequences arising from your reliance on it. You may use the Results and rewritten text generated from your own Submitted Text for your own purposes, but you agree not to resell, distribute commercially, or present the Content as a certificate or proof of authorship or originality.

You may not remove, alter, obscure, or circumvent any technical limitations, access controls, watermarks, notices, or other safeguards that we implement in connection with the Content or the Services.

We retain all rights, title, and interest in and to the Services and in the format and presentation of the Results, including any intellectual property rights therein. You retain ownership of your Submitted Text and of the rewritten text generated from it. Unauthorized use, reproduction, or distribution of the Services or their presentation is strictly prohibited and may result in termination of your access to the Services and legal action.

The Services are decision-support tools. They do not replace professional judgment, editorial review, academic due process, or human assessment. Plagiarism checking compares Submitted Text against the sources available to our providers at the time of the scan and may not identify every source, every paraphrase, every citation issue, or every form of academic misconduct.

Because Results and rewritten text are generated automatically, similar or identical output may be generated for other users, and rewritten text may not be unique to you.

A matched source indicates textual similarity requiring review. It does not establish that the Submitted Text was copied, that the source is original, or that the source is accurate. Matched sources are third-party content outside our control, and the sources available for comparison change over time.

Any accuracy figures we publish describe performance under the test conditions stated alongside them and are not a guarantee of performance on any particular text. References to the artificial intelligence systems covered by AI detection describe the scope of the detection model at the time of publication. Detection models, data sources, and providers may change over time, and the same Submitted Text may produce different Results at different times.

PDF downloads reproduce the Results available at the time of export, state the date of the scan and that the Results are probabilistic estimates, and do not constitute a certificate, verification, or proof of authorship or originality.

If you believe that any Content is inaccurate, you may contact our support team. While we may, in our discretion, review and address concerns, we have no obligation to update, correct, remove, or re-issue Content unless required by applicable law, and we may require reasonable verification and details to investigate your request.

7. USER-GENERATED CONTRIBUTIONS

The Services may provide you with the opportunity to post, create, submit, display, transmit, or otherwise contribute content and materials, including but not limited to text, comments, feedback, and other forms of user submissions (collectively, “Contributions”). By making any Contributions to the Services, you acknowledge and agree that:

You are solely responsible for your Contributions and any consequences resulting from their creation, distribution, or public display.

Your Contributions do not and will not infringe upon the proprietary rights of any third party, including but not limited to copyrights, patents, trademarks, trade secrets, or moral rights.

You are the creator and owner of your Contributions or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us, the Services, and other users of the Services to use your Contributions in any manner contemplated by these Terms.

Your Contributions are not false, inaccurate, misleading, or deceptive.

Your Contributions do not contain unsolicited or unauthorized advertising, promotional materials, spam, chain letters, pyramid schemes, mass mailings, or any other form of solicitation.

Your Contributions do not include or promote content that is obscene, defamatory, harassing, violent, or otherwise objectionable as determined by us in our sole discretion.

Your Contributions do not contain threats, hate speech, or any content intended to ridicule, intimidate, or abuse any individual or group.

Your Contributions do not violate any applicable laws, regulations, or legal rights, including but not limited to privacy, publicity, and child protection laws.

Your Contributions do not contain malware, viruses, or any other harmful software that could damage, interfere with, or disrupt the functionality of the Services.

Submitted Text: Text submitted solely to obtain Results is not considered a public user contribution and is not governed by the licence applicable to user-generated content such as reviews, testimonials, or comments.

When you submit text, you grant ClarityCheck a limited, non-exclusive, non-transferable, revocable (to the extent technically feasible after processing), worldwide licence solely to host, reproduce, temporarily cache, transmit to the providers identified in our Privacy Policy, analyse, rewrite where you request it, and otherwise process the Submitted Text as reasonably necessary to:

perform the requested AI detection, plagiarism check, or rewrite;

generate and display Results;

maintain your Scan History;

prevent fraud, abuse, and misuse of the Services;

provide customer support;

comply with applicable law and legal obligations.

ClarityCheck will not use Submitted Text for advertising, promotional activities, AI model training, or any unrelated commercial purpose unless you separately and expressly consent to such use.

By submitting text, you represent and warrant that you are at least 18 years old and that you wrote the text, own it, or otherwise possess all necessary rights, permissions, and legal authority to submit it for the requested service, and that it does not contain personal data of others that you have no right to process.

Submitted Text, Results, and rewritten text are retained and deleted in accordance with the Privacy Policy. This licence automatically terminates once the applicable retention period expires, except to the extent retention is required for security, fraud prevention, legal compliance, or backup restoration under the Privacy Policy.

You waive any claims against us for any alleged or actual infringements of proprietary rights, moral rights, rights of privacy, or rights of attribution related to your Contributions.

We reserve the right, but are not obligated, to review, edit, refuse, or remove any Contributions at our sole discretion for any reason, including violations of these Terms or applicable laws. We assume no liability for any Contributions posted, stored, or uploaded by users, nor are we responsible for any loss or damage resulting from user-generated content.

If you believe any user Contributions violate these Terms, please contact our support team to report the content.

8. RESERVED RIGHTS

We reserve the right, at our sole discretion, to modify, suspend, or terminate any aspect of the Services at any time, without prior notice or liability. This includes, but is not limited to, changes to the functionality, features, subscription plans, or availability of the Services. We may also impose limitations on certain features, restrict access to parts or all of the Services, or discontinue specific offerings entirely. We further reserve the right to:

Modify these Terms at any time. Any changes will be effective upon posting on our website or notification to you. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.

Refuse or restrict access to the Services for any user, at our sole discretion, including in cases of suspected misuse, violation of these Terms, or fraudulent activity.

Monitor, review, or remove any content or activity on the platform that we deem inappropriate, harmful, or in violation of these Terms, without notice or liability.

Enforce compliance with these Terms and applicable laws through any lawful means, including account suspension or termination.

All intellectual property rights in and to the Services, including but not limited to software, content, trademarks, logos, and trade secrets, remain the sole property of their respective owners. Nothing in these Terms shall be construed as transferring or granting any rights other than those expressly set forth herein.

By using the Services, you acknowledge and agree to these reserved rights and accept that any changes or decisions made under this section are final and binding. If you do not agree with any modifications to the Services or these Terms, your sole remedy is to discontinue your use of the Services.

9. PAYMENT TERMS

Subscription Options: We offer flexible subscription plans to meet your needs, including 7 days (weekly), 28 days and 30 days options. All users begin with a paid 7-day trial that includes limited access to the Services.

7-Day Trial:

Your trial is charged at a nominal price, which is displayed to you at checkout before you confirm your purchase.

Depending on your region, location, or payment method, your trial payment may be processed as two separate transactions.

The first payment activates your trial subscription.

The second payment confirms that your payment method on file supports recurring charges.

We process this verification because we are providing the trial at a nominal price and need to ensure your payment method is valid for future billing.

The total amount charged is the same whether it is processed as one transaction or two.

Includes 2 credits for use during the trial period.

Trial converts automatically to the selected subscription plan unless canceled before the trial period ends.

Standard Subscription:

Billed every 28 days.

Includes 20 credits per billing cycle.

Standard Subscription for users from Brazil:

Billed every 30 days.

Includes 20 credits per billing cycle.

Additional Credits:

You may purchase additional credit packages at any time. Package sizes and prices are shown at checkout.

One-Time Purchases:

PDF Downloads — charged once per report and available during your active subscription period.

Prices are displayed at checkout and on our pricing page, and are subject to change at our sole discretion. We reserve the right to modify, adjust, or update our subscription fees, trial pricing, credit package rates, and one-time purchase prices for any reason, including but not limited to changes in operational costs, supplier or provider pricing adjustments, market conditions, or business decisions. We will not change the price of your active subscription without providing you advance notice via email or in-app notification. You will always have the opportunity to cancel your subscription before any price increase takes effect. Price changes for new subscribers or new purchases may take effect immediately upon notice, which may be provided by updating these Terms & Conditions. Your continued use of the Service following the effective date of any price change constitutes your acceptance of the revised pricing.

We accept all major credit and debit cards as well as select regional payment options. All payments are processed securely through a PCI-DSS-compliant provider to ensure the safety of your transactions. Subscriptions are set to auto-renew unless canceled prior to the end of the current billing cycle. The subscription rate you select will automatically be charged to the payment method on file at the start of each new billing cycle. You may cancel your subscription at any time via our Cancellation Hub. See Section 12 (Cancellation) for full details of the cancellation process.

In the event of a failed payment, we will attempt to process the charge multiple times over a 30-day period. If the payment remains unsuccessful after 30 days, your account may be suspended, and access to the Services will be restricted until payment is resolved. Any changes to subscription pricing will be communicated in advance. Existing subscribers will be notified of rate changes and given the option to cancel their subscription before the new pricing takes effect.

Trial fees are refundable within 7 days of purchase, provided no credits have been used. Regular subscriptions are non-refundable, except in specific cases such as service unavailability exceeding 24 hours (excluding scheduled maintenance or force majeure events) or billing errors like duplicate charges or incorrect amounts. Refund requests must be submitted within 30 days of the charge and will be verified by our support team before processing. Further details are set out in our Refund Policy.

Refunds will not be provided for partial or unused subscription time after cancellation, changes to subscription plans or features, or failure to cancel before the next billing cycle. If eligible for a refund, you must submit a request through our help center or via email. Include your account email, transaction details, and reason for the refund request. Refunds are typically processed to the original payment method within 3-5 business days.

We support payments in local currencies for certain regions. If local currency payments are unavailable, charges will be processed in USD. Currency conversion rates and fees are determined by your bank or card issuer, and we are not responsible for any additional charges resulting from these conversions.

United Kingdom (UK) & European Union (EU): Prices are displayed in the local currency and charge is processed in the local currency as well. Australia (AU): The price will be converted from USD to AUD based on the current exchange rate at the time of the transaction.

Canada (CA): The price will be converted from USD to CAD based on the current exchange rate at the time of the transaction.

Our pricing may also vary based on ongoing promotions, regional payment options, testing initiatives, or other factors. The price displayed during your checkout process reflects the applicable price for your purchase or subscription at that time. By proceeding with your purchase, you acknowledge and accept the price as final for that transaction. In the case of a discrepancy due to billing errors, duplicate charges, or system issues, please contact our support team for resolution.

For countries outside the EU, UK, Australia, US, and Canada, prices are denominated in USD. The cost of products is converted from USD to local currencies based on the current international exchange rate. The price will be adjusted according to the exchange rate at the time of the transaction and displayed in the local currency.

By proceeding with a subscription or purchase, you agree to these payment terms, including automatic renewals, cancellation policies, and the non-refundable nature of most charges. If you have questions or require assistance, please contact our support team.

10. INDEPENDENCE FROM THIRD-PARTY TOOLS AND INSTITUTIONS

ClarityCheck AI is not affiliated with, endorsed by, or connected to any school, university, publisher, employer, or third-party AI detector or plagiarism checker, including any named on the Services. We do not share your Submitted Text, Results, or Scan History with any school, employer, or other institution.

11. COMMUNICATION

By using the Services, you consent to receive transactional and service-related communications from us, including but not limited to emails regarding account activity, purchases, trial and subscription renewals, links to your Results, and system updates. These communications are necessary for the proper functioning of the Services and cannot be opted out of unless you delete your account.

Additionally, if you submit text but do not complete your purchase, you may receive follow-up emails reminding you to finalize your transaction. You can opt out of these follow-up emails at any time by clicking the unsubscribe link provided in the email or adjusting your communication preferences in your account settings.

We may also send you promotional or marketing emails about new features, special offers, or updates to the Services. You have the option to unsubscribe from these marketing communications at any time by clicking the unsubscribe link in the email. However, opting out of marketing communications will not affect service-related communications that are necessary for your account.

If you have any questions about our communications or wish to manage your preferences, please contact our support team.

12. CANCELLATION

You may cancel your subscription to the Services at any time through one of the following methods:

You may cancel in your account settings, or by navigating to our Help Center and proceeding to the cancellation hub. In the cancellation hub, you will be prompted to provide your account details, including the email address associated with your subscription, and schedule the cancellation.

Cancellations can be scheduled to take effect starting from the next billing cycle. For example, if your subscription renews on January 1 and you did not use any credits or cancel before that date, you may still schedule the cancellation to take effect at the beginning of the following billing cycle.

If you experience any issues with the cancellation hub or require further assistance, you may contact our support team via email at help@claritycheck.com. When submitting a support ticket, please include your account details and a clear statement requesting cancellation. A support representative will process your request within 1-2 business days and provide confirmation via email.

Your subscription will remain active until the end of your current billing period. Cancellation will take effect at the start of the next billing cycle, and no further charges will be applied. Your credits remain in your account after cancellation, do not expire, and can still be used. Additional features, such as PDF downloads, remain available for the duration of your active subscription.

We recommend that you retain your cancellation confirmation for your records. If you experience any issues with cancellation or require additional assistance, please contact our support team promptly. Failure to cancel your subscription in accordance with this section may result in continued charges for which you will be responsible.

ClarityCheck does not authorise, endorse, or recognise any third-party service that offers to cancel a subscription, request a refund, or submit a data access, correction, or deletion request to us on a customer's behalf ("Third-Party Representative"). We will not act on any request, letter, or notice submitted by a Third-Party Representative, however it is described (including as "legally binding"), unless and until we have independently verified the request directly with the account holder using the email address associated with their ClarityCheck account.

Where a request relates to personal data under the California Consumer Privacy Act, UK/EU GDPR, or similar law, we will process it only in accordance with our identity- and authority-verification requirements under those laws, including verifying directly with the consumer that they authorised the agent to act (Cal. Code Regs. tit. 11, § 7063).

If you wish to cancel your subscription or exercise any data right, please do so directly through your account settings or by contacting us from the email address on file. We are not responsible for any fees, delays, or consequences arising from using a third-party representative.

13. USER OBLIGATIONS

By accessing or using the Services, you agree to comply with all obligations outlined in these Terms. Your use of the Services is conditioned upon your adherence to the following requirements:

Lawful and Ethical Use: You agree to use the Services only for lawful purposes and in accordance with all applicable laws, regulations, these Terms, and any academic, professional, or workplace rules that apply to you. You may not use the Services, the Results, or rewritten text for any unlawful, fraudulent, or malicious purpose, including but not limited to: submitting text you have no right to submit, such as confidential, stolen, or copyrighted material you are not entitled to use; harassing, defaming, or publicly accusing any person on the basis of a Result; or processing other people’s personal data without a lawful basis. The Services must not be used to infringe the intellectual property, privacy, or other rights and legal protections of others.

Personal Use: The Services are provided solely for your personal, non-commercial use. You are prohibited from reselling or commercially distributing Results or the Services without our prior written consent.

Accuracy of Information: You are responsible for providing accurate, current, and complete information when creating an account and throughout your use of the Services. Misrepresentation of your identity, purpose, or other relevant details is strictly prohibited and may result in the suspension or termination of your account.

Account Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account. If you suspect unauthorized access to your account, you must notify us immediately. We are not liable for any loss or damage arising from your failure to maintain the security of your account.

Proper Use of Results: You agree to use Results responsibly and solely for lawful purposes. You may not present any Result, score, or PDF as proof of authorship, originality, misconduct, or of any person’s guilt or innocence, and you may not use Results as the sole basis for academic, disciplinary, or employment decisions about any individual. You are responsible for any consequences resulting from your use or misuse of Results.

Use of Rewriting Tools: You are solely responsible for complying with the rules of any school, institution, publisher, employer, or platform that apply to the text you submit or to rewritten text. You may not use the Humanizer or the Plagiarism Remover to misrepresent who wrote a text or to conceal plagiarism in work you submit as your own. Rewriting a passage does not remove any obligation to cite its source. You must review rewritten text before using it. Rewriting may alter meaning, introduce factual errors, or produce unnatural or inaccurate wording, and you are responsible for checking facts, figures, quotations, and citations. You may use the Humanizer and the Plagiarism Remover only on text you wrote or are otherwise entitled to modify. You may not use them to republish, or to present as your own, content written by another person, and rewriting does not grant you any rights in the source material.

Human Review of Results: You agree not to use any Result, score, or PDF as the sole basis for any decision, accusation, or action that may materially affect a student, employee, contractor, applicant, writer, or any other person. Before taking any such action, you must apply human review, consider other available evidence, and give the person concerned an appropriate opportunity to respond.

Rights in Submitted Text: By submitting text, you represent and warrant that you wrote the text, own it, or otherwise possess all necessary rights, permissions, and legal authority to submit it, and that it does not contain personal data of others that you have no right to process. You further consent to ClarityCheck processing the Submitted Text, including transmitting it to the providers identified in our Privacy Policy, as reasonably necessary to perform the requested service. Such processing and retention are governed by these Terms and our Privacy Policy. If you submit text written by another person, such as a student, employee, contractor, or client, you are responsible for having a lawful basis to do so and for providing any notice or obtaining any consent required by applicable law. You should not submit special categories of personal data, government identifiers, or confidential information unless they form part of text you are entitled to check.

No Misuse; No Harmful Conduct: In addition to the restrictions above, you agree not to use the Services or any Content to harass, threaten, intimidate, defame, unlawfully discriminate against, or otherwise cause harm to any person, and you acknowledge that you are solely responsible for ensuring that your use of the Services and Content is lawful in your jurisdiction and consistent with these Terms.

Prohibition on Unauthorized Access: You may not attempt to gain unauthorized access to the Services, servers, or databases, nor may you interfere with or disrupt the operation of the platform. This includes but is not limited to using automated tools, bots, or scripts to access or extract data, reverse-engineering the platform, or deploying malware or other harmful software.

Compliance with Disclaimers and Limitations: You acknowledge and agree to abide by all disclaimers, warnings, and limitations provided within these Terms or on the platform. This includes understanding the inherent limitations of automated analysis and the permissible uses of the Services.

No Circumvention of Safeguards: You may not remove, alter, obscure, or bypass any access controls, rate limits, technical restrictions, export limitations, watermarks, notices, or other safeguards implemented by us or our providers in connection with the Services or Content.

Failure to adhere to these obligations constitutes a breach of these Terms and may result in the suspension or termination of your account, as well as potential legal action. By using the Services, you accept full responsibility for your actions and agree to indemnify us against any claims, damages, or liabilities arising from your misuse of the Services. You further acknowledge that you are solely responsible for ensuring that your use of the Services is lawful and compliant with all applicable laws.

14. RESTRICTIONS ON USE

Your access to and use of the Services is subject to the following restrictions. By using the Services, you agree not to engage in any activity that violates these Terms or applicable laws, including but not limited to:

Unauthorized Access: You may not attempt to gain unauthorized access to the Services, servers, systems, or networks connected to the platform. This includes, but is not limited to, hacking, password mining, or any other means of circumventing security measures.

Automated Data Collection: The use of bots, scripts, crawlers, or other automated tools to scrape, extract, or harvest data from the Services, or to submit text automatically, is strictly prohibited. All submissions must be made manually through authorized methods provided by the platform.

Reverse Engineering: You may not attempt to decompile, reverse-engineer, disassemble, or otherwise manipulate the underlying code, algorithms, scoring models, or architecture of the platform.

Prohibited Uses of Results: You may not use Results or rewritten text for any unlawful activity, including:

  • Academic discipline, employment decisions, or other determinations about an individual based solely on Results.

  • Harassment or defamation.

  • Any activity that infringes upon the privacy or rights of others.

Reselling or Redistribution: The Services and Results are for your personal use only. You may not resell or commercially distribute the Services or Results with any third party without prior written consent.

Disruption of Services: You may not engage in any activity that interferes with or disrupts the functionality or performance of the platform, including overloading servers, introducing malicious software, or engaging in denial-of-service attacks.

Impersonation and Misrepresentation: You may not impersonate any individual or entity or misrepresent your identity, intent, or affiliation when using the Services, or misrepresent the authorship of any text. Misuse of the platform to conduct fraudulent or deceptive activities is strictly prohibited.

Prohibited Content: You may not upload, post, or transmit any content through the Services that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.

Compliance with Laws: You agree to comply with all applicable laws and regulations when using the Services. This includes but is not limited to data protection laws, privacy laws, and intellectual property laws.

Competitive Use and Benchmarking: You may not use the Services or Results to create, train, fine-tune, test, or improve any competing AI detector, plagiarism checker, humanizer, paraphrasing tool, machine learning model, or dataset, or publish comparative benchmark results, without our prior written consent.

Third-Party Provider Rules: Where a feature is fulfilled by a third-party artificial intelligence provider, you must also comply with that provider’s applicable usage policies, and we may restrict use of the feature to the extent required to comply with them.

Violating these restrictions may result in the suspension or termination of your account, denial of access to the Services, and potential legal action. We reserve the right to investigate suspected violations and take appropriate action, including reporting unlawful activities to law enforcement authorities.

15. SECURITY AND VULNERABILITY REPORTING

If you believe you have identified a security vulnerability affecting the Services, please report it promptly to security@claritycheck.com in accordance with our Vulnerability Disclosure Policy.

Good-faith security research conducted in compliance with that policy is authorized under these Terms. Security researchers must act responsibly, access only the minimum information reasonably necessary to demonstrate the reported issue, avoid disrupting the Services or affecting other users, and stop testing immediately if they encounter personal information beyond what is reasonably necessary to validate the vulnerability.

Researchers must not retain, copy, disclose, publish, or use personal information obtained during testing except to the extent reasonably necessary to report the vulnerability to ClarityCheck.

Submission of a vulnerability report does not create an entitlement to compensation, a bug bounty, or any other payment unless ClarityCheck expressly agrees otherwise in writing. We reserve the right to determine, at our sole discretion, whether a reported issue qualifies for any recognition or discretionary reward.

Nothing in this Section authorizes social engineering, denial-of-service attacks, physical attacks, spam, malware deployment, excessive automated testing, persistent access to systems, or any activity prohibited by applicable law.

16. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the operators of the Services, their affiliates, officers, directors, employees, agents, licensors, and service providers (collectively, the “Indemnified Parties”) from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your Use of the Services: Any misuse, unauthorized use, or illegal activity involving the Services or information obtained through the Services, including violations of these Terms or applicable laws.

Breach of Agreement: Your breach or violation of any provision of these Terms, including but not limited to representations, warranties, or obligations outlined herein.

Third-Party Claims: Any claims made by third parties arising from or related to your use of the Services, including claims alleging unauthorized access, misuse of information, or infringement of intellectual property, privacy, or other rights.

Data Use: Any liability arising from your use of the Results or rewritten text provided through the Services, including but not limited to claims of defamation, invasion of privacy, or wrongful reliance on the information.

Submitted Text: Any claims arising from text you submit, including claims that it infringes the rights of others or contains personal data you had no right to submit, and from decisions you make or support using Results.

Account Security: Any unauthorized activity conducted through your account, whether by you or any person who accesses the Services using your credentials.

The Indemnified Parties reserve the right, at their own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such a case, you agree to cooperate fully with the defense of such claims and refrain from entering into any settlement that imposes liability or obligations on the Indemnified Parties without their prior written consent.

This indemnification obligation survives the termination of your use of the Services or the expiration of these Terms. You acknowledge and agree that your indemnification obligations are intended to protect the Indemnified Parties from any harm or liability resulting from your actions or misuse of the Services.

17. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, THE OPERATORS OF THE SERVICES, THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS (COLLECTIVELY, THE “RELEASED PARTIES”) SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES, INCLUDING BUT NOT LIMITED TO:

LOSS OF DATA: ANY LOSS, DELETION, OR CORRUPTION OF SUBMITTED TEXT, RESULTS, REWRITTEN TEXT, OR REPORTS GENERATED OR OBTAINED THROUGH THE SERVICES.

BUSINESS INTERRUPTION: LOSS OF REVENUE, PROFITS, BUSINESS OPPORTUNITIES, OR ANTICIPATED SAVINGS.

THIRD-PARTY CLAIMS: CLAIMS MADE BY THIRD PARTIES ARISING FROM YOUR USE OF THE SERVICES OR RELIANCE ON THE INFORMATION PROVIDED.

SERVICE AVAILABILITY: INTERRUPTIONS, DELAYS, OR FAILURES OF THE SERVICES, INCLUDING TECHNICAL ISSUES OR SYSTEM DOWNTIME.

ACCURACY OF INFORMATION: ANY ERRORS, INACCURACIES, OR OMISSIONS IN THE RESULTS OR REWRITTEN TEXT PROVIDED THROUGH THE SERVICES.

DECISIONS BASED ON RESULTS: ANY ACADEMIC, EMPLOYMENT, PROFESSIONAL, OR OTHER CONSEQUENCES OF DECISIONS MADE BY YOU OR ANY THIRD PARTY BASED ON RESULTS, SCORES, REWRITTEN TEXT, OR PDFS.

IN NO EVENT SHALL THE TOTAL LIABILITY OF THE RELEASED PARTIES EXCEED THE AMOUNT PAID BY YOU TO ACCESS THE SERVICES DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT MADE ANY PAYMENTS TO ACCESS THE SERVICES, THE RELEASED PARTIES’ TOTAL LIABILITY TO YOU SHALL NOT EXCEED $100.

You acknowledge and agree that the limitations of liability set forth in this section are an essential basis of the agreement between you and the operators of the Services and reflect a fair allocation of risk. These limitations apply regardless of the form of action, whether based on contract, tort (including negligence), strict liability, or any other legal or equitable theory, and even if the Released Parties have been advised of the possibility of such damages.

Certain jurisdictions may not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply, and you may have additional rights under applicable law. However, in no event shall the liability of the Released Parties exceed the maximum extent permitted by law.

18. DISCLAIMER OF WARRANTIES

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, the operators of the Services, their affiliates, officers, directors, employees, agents, licensors, and service providers (collectively, the “Disclaiming Parties”) expressly disclaim all warranties, including but not limited to:

Implied Warranties: Any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of information.

Service Availability: Any warranties that the Services will be uninterrupted, error-free, or free from harmful components such as viruses or malware.

Accuracy of Information: Any warranties regarding the completeness, reliability, or accuracy of the Results, rewritten text, or information provided through the Services.

Results or Outcomes: Any warranties or representations that the Services will meet your requirements, expectations, or intended use, that the Results obtained from using the Services will be accurate or reliable, or that any text, including rewritten text, will satisfy any detector, plagiarism checker, school, publisher, platform, or employer.

You acknowledge that Results and rewritten text are generated automatically using third-party analysis and language-model providers and may include inaccuracies or omissions. The Disclaiming Parties do not warrant or guarantee the timeliness, accuracy, or reliability of any Results or rewritten text.

You assume full responsibility for your use of the Services and any information obtained through them. The Disclaiming Parties are not responsible for any decisions or actions you take based on the Results or rewritten text provided, and you use the Services entirely at your own risk.

Certain jurisdictions do not allow the exclusion of certain warranties. If these laws apply to you, some or all of the above exclusions may not apply, and you may have additional rights under applicable law. However, any warranties not expressly disclaimed herein are limited to the maximum extent permitted by law.

By using the Services, you expressly agree to this disclaimer of warranties and acknowledge that the Disclaiming Parties shall not be held liable for any issues arising from your use of the Services. If you are dissatisfied with the Services, your sole remedy is to discontinue their use.

19. EQUITABLE RELIEF

You acknowledge and agree that any unauthorized use of the Services, including but not limited to accessing, distributing, or using the information, data, or intellectual property in violation of these Terms, may cause irreparable harm to the operators of the Services and their affiliates. In such cases, monetary damages may not provide a sufficient remedy, and the operators of the Services shall be entitled to seek injunctive or other equitable relief to prevent or mitigate such harm without the necessity of posting a bond or other security. You further agree that:

Scope of Relief: Equitable relief may include, but is not limited to, temporary restraining orders, preliminary and permanent injunctions, and specific performance.

Non-Exclusive Remedies: The availability of equitable relief does not preclude the operators of the Services from seeking any other remedies available under applicable law, including monetary damages or legal costs.

Consent to Jurisdiction: You consent to the jurisdiction of any court with proper authority to grant such equitable relief and agree to cooperate fully with any proceedings necessary to enforce these Terms.

Any breach or threatened breach of these Terms, particularly concerning the misuse of proprietary data, intellectual property, or other confidential materials, shall entitle the operators of the Services to seek immediate and appropriate equitable relief in addition to any other remedies available at law or in equity.

20. PROHIBITED USES

Users are required to adhere to specific standards of conduct to maintain the integrity and functionality of the Service. The following activities are strictly prohibited on the Service and constitute a violation of these Terms:

Illegal Activities: Users shall not use the Service for any unlawful purposes, nor in furtherance of illegal activities. This includes, but is not limited to, engaging in fraud, theft, or any other criminal behavior.

Infringement of Intellectual Property: Users are prohibited from posting, sharing, or otherwise distributing any content that infringes upon the intellectual property rights of others, including copyrights, trademarks, patents, trade secrets, or any other proprietary rights. Submitting text solely to obtain Results, including text that may contain material from other sources, is not distribution under this Section.

Harassment and Abuse: Users must not engage in harassment, bullying, or any other behavior that is intended to threaten, intimidate, or coerce other users or individuals, including publicly accusing any person of using AI or of plagiarism on the basis of a Result. This includes the use of abusive, defamatory, offensive, or obscene language and content.

Misrepresentation and Impersonation: Users are forbidden from impersonating any person or entity, or falsely stating or otherwise misrepresenting their affiliation with a person or entity, or the authorship of any text. This also includes providing false or misleading information during the account creation or verification process.

Spam and Malware Distribution: Users must not use the Service to transmit spam, including unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation. The distribution of viruses, malware, or any other harmful or destructive software or data is also strictly prohibited.

Interference with the Service: Users shall not interfere with or disrupt the Service or servers or networks connected to the Service, nor disobey any requirements, procedures, policies, or regulations of networks connected to the Service.

Content Violations: Users are prohibited from posting or transmitting content that is violent, pornographic, discriminatory, or otherwise offensive or inappropriate, as determined in the sole discretion of ClarityCheck.

Bypassing Security Measures: Attempting to bypass any measures ClarityCheck may use to prevent or restrict access to the Service, including attempting to access areas or features of the Service for which the user does not have access rights, is strictly prohibited.

Violations of these prohibited uses may lead to immediate termination of the user's account and legal action, where appropriate.

21. DATA PRIVACY

Your use of the Services is subject to our Privacy Policy, which governs how we collect, use, store, and protect your personal information, including Submitted Text. In the event of any conflict between these Terms and the Privacy Policy regarding privacy practices, the Privacy Policy governs.

22. THIRD PARTY LINKS

The Services may contain links to external websites and resources provided by third parties. These links are provided for your convenience and information only. The inclusion of any link does not imply endorsement, approval, or control by the Company of the external site or its contents. These third-party sites have their own terms and conditions and privacy policies, which we do not govern or endorse.

When you access third-party websites, you do so at your own risk. You acknowledge that different terms of use and privacy policies may apply to your use of such third-party services and content. We encourage you to review the terms and privacy policies of any third-party website or service that you visit.

The Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any such third-party websites or services. We do not guarantee the accuracy, completeness, or usefulness of any information on third-party websites and do not warrant the safety or legality of any third-party website or service.

The presence of links to third-party websites, including links to sources matched by a plagiarism check, does not constitute an affiliation with, endorsement of, or sponsorship by the Company of those websites, their operators, or the content, products, or services contained or accessible through those websites.

We reserve the right, at any time and without notice, to add to, change, update, or modify our Services, including the removal or alteration of any third-party links. However, we do not have any obligation to review, monitor, check, or remove any third-party content or websites.

23. INTELLECTUAL PROPERTY

All content, materials, and intellectual property featured or displayed on the Services, including but not limited to text, graphics, logos, icons, images, software, scoring models, page layout, design, and any other content (collectively, "Content"), are the exclusive property of ClarityCheck, its affiliates, or its licensors and are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws. Your Submitted Text and the rewritten text generated from it are not ClarityCheck Content and remain yours.

Ownership of Intellectual Property: ClarityCheck and its licensors retain all rights, title, and interest in and to the Services and its Content. The use of the Services does not grant you any ownership or intellectual property rights in the Services or the Content, except as expressly provided in these Terms.

License to Use the Services: ClarityCheck grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services and its Content solely for your personal use, as permitted by these Terms.

Restrictions on Use: You agree not to:

Copy, reproduce, modify, create derivative works from, display, perform, publish, distribute, transmit, broadcast, or otherwise exploit any portion of the Services or its Content without the prior written consent of ClarityCheck.

Remove, alter, obscure, or interfere with any copyright, trademark, or other proprietary rights notices displayed on or within the Services or its Content.

Reverse engineer, decompile, or disassemble any part of the Services, except to the extent that such activity is expressly permitted by applicable law.

Trademarks: All trademarks, service marks, logos, trade names, and trade dress (collectively, "Trademarks") displayed on the Services are the property of ClarityCheck or their respective owners. Names of third-party artificial intelligence systems are used solely to describe the scope of detection and remain the property of their respective owners. The use of any Trademarks without the express written consent of ClarityCheck or the respective owner is strictly prohibited. Nothing on the Services or in these Terms should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Services without our written permission or that of the third-party rights holder.

Reporting Intellectual Property Violations: If you believe that any content on the Services infringes your intellectual property rights, please contact us with detailed information about the alleged infringement, including a description of the content, the location on the Services, and proof of your ownership of the intellectual property rights. ClarityCheck reserves the right to remove or disable access to any content that it believes, in its sole discretion, may infringe the intellectual property rights of others.

Notices of alleged infringement should be sent to help@claritycheck.com and must identify the material concerned, its location on the Services, the rights you claim, and your contact information, together with a statement that the information provided is accurate. Knowingly submitting false or misleading notices may result in liability and action against the submitting account.

Reservation of Rights: ClarityCheck reserves all rights not expressly granted in these Terms. No part of the Services or its Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way without the express prior written consent of ClarityCheck, except as expressly permitted in these Terms.

24. DISPUTE RESOLUTION

To ensure disputes are addressed fairly and efficiently, users are required to follow a structured resolution process before pursuing arbitration or court proceedings. By using the Services, you agree to comply with this process.

Disputes must first be resolved informally. Users are required to make a good faith effort to resolve any issues directly with our support team within 30 days of the dispute arising. This initial step can be initiated by contacting our support team through standard channels or via email at help@claritycheck.com, where you should clearly describe the issue, including relevant details.

If the informal resolution does not resolve the issue, users may escalate the matter by submitting a formal complaint to escalations@claritycheck.com. The complaint must include the user’s account details, a description of the dispute, and any supporting documentation. We will respond to escalations within five business days. Should this response fail to address the user’s concerns, the dispute can be escalated further to escalations-management@claritycheck.com, where it will undergo a comprehensive management review. A final internal decision will be provided in writing within fifteen business days of receipt.

If the formal escalation process does not yield a satisfactory resolution, disputes must be submitted to binding arbitration conducted by the American Arbitration Association (AAA). Arbitration will be conducted in English by a single arbitrator and may take place virtually. Arbitration must be filed within six months of the dispute arising. Both parties will share filing and arbitrator fees equally unless otherwise awarded, and each party will bear its own legal costs unless decided otherwise by the arbitrator.

There are limited exceptions to the arbitration requirement. Intellectual property disputes, small claims court cases, and requests for emergency injunctive relief are not subject to arbitration and may proceed directly to the appropriate court or forum. Court litigation for other disputes is only permitted after the full resolution process has been followed.

To maintain fairness and efficiency, consolidated claims, class actions, and representative actions are explicitly prohibited under these Terms. By agreeing to this process, you acknowledge that all disputes related to the Services must follow the outlined steps and agree to the terms of resolution, including the binding nature of arbitration where applicable.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND CLARITYCHECK EACH WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES THAT IS NOT SUBJECT TO ARBITRATION UNDER THIS SECTION.

25. GOVERNING LAW

THESE TERMS AND YOUR USE OF THE SERVICES ARE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF DELAWARE, WITHOUT REGARD TO ITS CONFLICT OF LAW PRINCIPLES. YOU AGREE THAT ANY DISPUTES, CLAIMS, OR CONTROVERSIES ARISING OUT OF OR RELATED TO THESE TERMS, THE SERVICES, OR YOUR USE OF THE SERVICES SHALL BE SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE STATE AND FEDERAL COURTS LOCATED IN DELAWARE. For users within the EU or EEA, these Terms shall also be governed by the laws of Delaware, USA, without prejudice to mandatory local laws applicable in your jurisdiction. Any disputes, claims, or controversies arising out of or related to these Terms, the Services, or your use of the Services may also be brought before the competent courts of Delaware, USA.

You expressly waive any objections to the jurisdiction, venue, or convenience of these courts. However, we reserve the right to seek injunctive or other equitable relief in any jurisdiction to protect our intellectual property or enforce these Terms.

By using the Services, you acknowledge and agree:

That Delaware law governs all matters arising out of or relating to these Terms and the Services.

That any legal actions or proceedings must be initiated and resolved in Delaware courts unless otherwise agreed by both parties in writing.

That any claim or cause of action arising out of your use of the Services must be brought within one (1) year after the claim or cause of action accrues, unless prohibited by applicable law.

In the event of multiple arbitration claims arising from or related to these Terms or the Services, involving ten or more claimants, the claimants agree to coordinate and consolidate their claims into a single arbitration proceeding to promote efficiency and fairness. A staged arbitration process may be applied, where an initial set of up to ten representative claims will be arbitrated first, with the remaining claims to follow based on the outcome of the initial stage. The arbitration provider will have the discretion to manage the coordinated process, including appointing arbitrators and setting procedures for efficient resolution of claims. All arbitration proceedings will take place in Delaware unless otherwise agreed by both parties in writing, and each party will bear its own costs and legal fees unless otherwise awarded by the arbitrator.

If any provision of this section is deemed unenforceable, it will not affect the validity or enforceability of any other provisions, and the remaining provisions shall remain in full force and effect.

26. AMENDMENTS

We reserve the right to modify, update, or change these Terms at any time and without prior notice. Any modifications will be effective immediately upon posting on our Services. It is your responsibility to review these Terms periodically to stay informed of any updates or changes. By continuing to access our website and use our services after the modifications have been made, you agree to be bound by the revised Terms.

Changes to Terms: We may modify these Terms to reflect changes in our business practices, legal requirements, or improvements to our services. We will make reasonable efforts to provide notice of material changes to these Terms. Such notice may be provided through our website, by email, or by other means we deem appropriate. It is your responsibility to review the updated Terms.

Continued Use: By continuing to access our website and use our services after the modifications have been made, you indicate your acceptance of the modified Terms. If you do not agree with the modified Terms, you should discontinue using our Services.

Effect on Prior Agreements: Any modifications to these Terms will apply prospectively and will not affect any rights or obligations that arose prior to the effective date of the modifications. If you have entered into any separate agreements with us, the terms of those agreements will prevail in the event of any inconsistency with these Terms, unless expressly stated otherwise.

Right to Terminate: We reserve the right to terminate, suspend, or restrict your access to our website and services, in whole or in part, at our sole discretion and without liability, if you fail to comply with these Terms or for any other reason we deem necessary.

Please note that any modifications to these Terms will not affect our commitment to protecting your privacy and maintaining the confidentiality and security of your personal information. Our privacy practices are governed by our Privacy Policy.

27. WAIVER

The failure or delay of ClarityCheck in exercising any right, remedy, power, or privilege under these Terms shall not constitute a waiver thereof. Similarly, any single or partial exercise of any right, remedy, power, or privilege hereunder shall not preclude further exercise of the same or of any other right, remedy, power, or privilege.

Any waiver by ClarityCheck of a breach of any provision of these Terms shall only be effective if it is in writing and signed by an authorized representative of ClarityCheck. A waiver of any term or provision shall not be construed as a waiver of any subsequent breach or default, whether of a similar nature or otherwise.

No waiver by ClarityCheck of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of ClarityCheck to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

28. HEADINGS

The headings used in these Terms are for convenience and reference purposes only. They do not limit, interpret, or define the scope or intent of the provisions contained herein. The headings are not intended to be legally binding or to affect the meaning or interpretation of these Terms.

Interpretation: The provisions contained in these Terms shall be interpreted in accordance with their plain meaning and intent, regardless of any headings or titles.

Organization and Structure: The headings used throughout these Terms are provided to aid in navigating and understanding the content. They are organized in a logical manner and reflect the general subject matter of the respective sections.

Non-Exclusive: The headings used in these Terms are not an exhaustive representation of the topics covered. Other terms and concepts may be included in each section, regardless of whether they are explicitly stated in the headings.

No Legal Significance: The headings are not intended to have any legal significance or to modify or alter the rights and obligations of the parties under these Terms. They are simply a structural element to enhance readability.

Please note that the headings provision is included for organizational purposes and does not impact the substantive rights and obligations set forth in these Terms.

29. SEVERABILITY

In the event that any provision or part of these Terms is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remainder of these Terms shall remain in full force and effect.

The invalid, illegal, or unenforceable provision shall be modified to the extent necessary to render it valid, legal, and enforceable while preserving its intent. If modification is not possible, the affected provision or part thereof shall be deemed severed from these Terms, but all other provisions and parts of these Terms shall continue in full force and effect.

The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of any other provision or part of these Terms, which shall remain in full force and effect as though such invalid, illegal, or unenforceable provision had never been included.

These Terms shall be construed as if each provision and part thereof were drafted independently, and any presumption or rule of construction against construing ambiguities in favor of the drafting party shall not apply to the interpretation or construction of these Terms.

30. ENTIRE AGREEMENT

These Terms, including any additional policies or agreements incorporated by reference, constitute the entire agreement and understanding between ClarityCheck and you, superseding all prior or contemporaneous communications, proposals, understandings, agreements, or representations, whether oral or written, between the parties regarding the subject matter herein.

You acknowledge that you have not relied upon any representation, promise, or warranty made by ClarityCheck, except as expressly set forth in these Terms.

Any modifications, amendments, or supplements to these Terms must be made in writing and signed by an authorized representative of ClarityCheck. No oral modifications or agreements shall be valid.

Any provision that, by its nature, should survive termination or expiration, shall survive termination or expiration, including but not limited to provisions governing intellectual property, limitation of liability, indemnification, dispute resolution, and governing law.

In the event of any conflict or inconsistency between the provisions of these Terms and any other agreements or policies, the provisions of these Terms shall prevail.
